First Offense DWI

If you were convicted of a first offense DWI in Minnesota, your license will be suspended. However, you may still regain driving privileges with the installation of an Intoxalock ignition interlock device. To obtain your ignition interlock restricted license with full Class D driving privileges you must:

  • Apply for the Class D driver's license, pay application fee and retain receipt
  • Pass the DWI knowledge test and pay a $680 reinstatement fee
  • Provide proof of insurance
  • Sign an ignition interlock participation agreement and submit required documents to MN DVS
  • Go to the Deputy Register to purchase special plates, if yours have been impounded*
  • Install an Intoxalock ignition interlock or BAIID device

*Required for a first offense with a 0.16 or higher BAC level

Second Offense DWI

If you were convicted of a second offense DWI in Minnesota within 10 years, your license will be suspended for one to two years. However, you may still regain driving privileges with the installation of an Intoxalock ignition interlock device.

In order to regain your license you must:

  • Pass the DWI knowledge test and pay a $680 reinstatement fee
  • Sign a Special Review Awareness Form
  • Provide proof of insurance
  • Sign an ignition interlock participation agreement
  • Submit test fees and any other required documents
  • Go to the Deputy Register to purchase special plates, if yours have been impounded
  • Install an Intoxalock ignition interlock or BAIID device

Third & Subsequent Offenses DWI

If you were convicted of a third DWI offense within a 10 year period, or have four or more alcohol offenses on record, your license will be canceled as inimical to public safety. However, you may still regain driving privileges with the installation of an Intoxalock ignition interlock device.

In order to regain your license, you must:

  • Enroll in a treatment program as recommended by a chemical evaluation. Your treatment provider or assessor must submit enrollment documents to MN DVS directly
  • Provide proof of insurance
  • Pass a DWI knowledge test and pay a $680 reinstatement fee
  • Sign an Ignition Interlock Participation Agreement and complete a Limited License Application
  • Sign a Last Use Statement Form
  • Go to the Deputy Register to purchase special plates, if yours have been impounded
  • Install an Intoxalock ignition interlock or BAIID device

In the case of third and subsequent offenses you must drive a vehicle with an ignition interlock device and have no detection of alcohol or drugs for:

3rd Offense: Three years with an ignition interlock (one year limited license and two years restricted license)

4th Offense: Four years with an ignition interlock (one year limited license and three years restricted license)

5th Offense: Six years with an ignition interlock (one year limited license and five years restricted license)

  • A limited license is a paper license that is issued while driving privileges are revoked allowing you to drive to work, school and abstinence-based support programs.
  • A restricted license allows a person to only drive a vehicle equipped with an ignition interlock. (some work vehicles may not be included)
